DUI and your license:


What happens to my license if I get a DUI and I am under 21?

First DUI conviction:

Your license will be suspended for 1 year

If your alcohol concentration was less than 0.08 grams, you may become eligible to apply for license reinstatement after 6 months

If your alcohol concentration was 0.08 grams or more, you may become eligible to apply for license reinstatement after 12 months.

During the 6 and 12 months referenced above, you will not be eligible for a limited driving permit (“work permit”)


Second DUI conviction:

Your license will be suspended for 3 years

After 12 months you may become eligible to apply for license reinstatement

During the 12 months referenced above, you will not be eligible for a limited driving permit (“work permit”)


What happens to my license if I get a DUI and I am over 21?

First DUI conviction:

Your license will be suspended for 1 year

After 120 days you may apply to have your driver’s license reinstated

During the 120 days referenced above, you may be eligible for a limited driving permit.


Second DUI conviction:

Your license will be suspended for 3 years

If this is your second, but your 1st DUI within the past 5 years, you may apply to have your license reinstated after 120 days.

If this is your second DUI within the past 5 years, you may apply for license reinstatement after 18 months

During the 18 months referenced above, you will not be eligible for a limited driving permit.


Third DUI conviction:

Your license will be suspended for 5 years


**The periods of suspension shall begin on the date that you are convicted**
